1. Operator and Scope
This website is operated by Origins Paintball Group Houston, LLC, doing business as TXR Paintball (“TXR,” “we,” “us,” or “our”), in Texas, United States. These terms apply to use of this website, including information pages, contact tools, chat, and links to park services.
By using the website, you agree to these website-use terms to the extent an agreement can lawfully be formed. If you do not agree, please do not use the website. Merely browsing does not purchase a service, authorize a recurring charge, sign an activity waiver, or provide promotional photo consent.
Bookings, memberships, employment applications, and park participation may have additional terms presented by TXR or the applicable service provider. Nothing here replaces mandatory consumer protections or a separately signed agreement.
2. Accurate Information and Authority
Provide accurate information when contacting us or arranging services. You must have the authority to make a reservation or submit information for another person. If you are under 18, use reservation and waiver services with an authorized parent or guardian’s involvement and permission as required.
Activity age requirements vary by type of play; review the relevant activity page and confirm requirements with TXR. If an external service requires an account, follow that provider’s account terms and protect your login information.
3. Reservations, Pricing, and Availability
Website descriptions, schedules, and prices are provided to help plan your visit and may change. Confirm the package, player count, age requirements, date, total charge, applicable taxes, equipment, and available add-ons before completing a purchase.
Prices and availability displayed during checkout, together with the terms disclosed before purchase, govern the reservation you authorize, subject to applicable law. Changes to website pricing do not by themselves change an already accepted booking. A submitted inquiry is not a confirmed reservation.
Reservations are made through our online booking service or another method confirmed by TXR. Contact us if a price or description appears inconsistent; we will review it rather than assume you have agreed to an undisclosed charge.
4. Payments and Memberships
Payments and membership sign-ups may be handled through external services. Review the total price and the applicable payment and membership agreement before authorizing payment.
Recurring billing applies only to a plan whose billing amount, frequency, renewal conditions, and cancellation method are disclosed at sign-up and that you authorize through the selected service. These website terms alone do not authorize automatic renewal or recurring charges.
Manage or cancel a membership using the method provided in your plan agreement, or contact TXR for assistance. Changes to recurring plans and billing remain subject to the disclosed agreement and applicable law.
5. Cancellations, Rescheduling, and Refunds
Cancellation, rescheduling, deposit, booking-fee, and refund terms are those disclosed for the particular reservation or membership before purchase, together with applicable law. Review them carefully and contact TXR promptly if your plans change.
These terms do not impose a new blanket “no refunds” rule or override any refund or cancellation right required by law. Weather, equipment availability, safety conditions, and event-specific requirements may affect operations; contact us about the options applicable to your booking.
6. Park Safety and the Separate Participant Waiver
Paintball, Gellyball, and other physical activities involve risks. Participants must meet activity requirements, follow staff instructions and posted safety rules, use required protective equipment, and complete the applicable participant waiver. An authorized parent or guardian must complete required permissions for a minor.
Review the TXR participant waiver before participating. These website terms are not an activity release, do not sign a waiver on your behalf, and do not expand the waiver’s scope. Participation-related rights and responsibilities are governed by the actual waiver and applicable law.
TXR may restrict participation for safety concerns, failure to meet eligibility requirements, or violation of park rules, subject to applicable agreements and law.
7. Acceptable Website Use
Do not use the website to commit fraud; submit unlawful, threatening, or abusive content; impersonate another person; misuse someone else’s information; transmit malware; bypass access controls; attempt unauthorized access; or interfere with the website or its services.
Do not use automated tools in a way that disrupts service, defeats security controls, or unlawfully collects personal information. We may limit access where reasonably necessary to protect the website, people, or legal rights.
8. Website Content and Information You Submit
Website text, branding, photos, videos, and other materials belong to TXR or their respective owners. You may use the website for personal visit planning, but may not republish or commercially exploit protected material without appropriate permission or another lawful basis.
You retain any rights you hold in content you submit. You permit us to use it only as reasonably needed to respond to your request, administer the service you request, and comply with applicable obligations. Do not submit content you are not authorized to provide. This permission is not a general promotional photo license.
9. Party Photography and Promotional Use
Our participant waiver describes the use of party photos for TXR promotions and social media unless you tell us you do not want that use, subject to the waiver, applicable law, and any required permissions.
Tell staff before photos are taken or email Help@TXRPaintball.com to opt out. Include enough detail to identify the participant, visit, or photo. A parent or guardian may request an opt-out for a child, and any legally required permission for a minor must come from an authorized parent or guardian.
Photo opt-outs and requests concerning already-posted images are explained in our Privacy Policy’s party photo section. Use of this website alone does not grant promotional photo permission. These website terms do not add broader photo rights than the applicable waiver and law allow.
10. External Services and AI Chat
External booking, waiver, membership, map, video, payment, and social media services are operated by their respective providers and may have their own terms and privacy policies. We do not control their availability, security, or independent practices.
Our AI chat is a convenience for general park information and may make mistakes. It does not confirm a booking, change an agreement, or give legal, medical, or other professional advice. Confirm important details—including pricing, availability, eligibility, and safety requirements—with TXR or the appropriate checkout page. In an emergency, contact emergency services rather than using chat.
11. Website Availability and Legal Protections
We aim to provide accurate, useful information, but the website may be interrupted, unavailable, or contain errors. To the extent permitted by law, website information is provided “as is” and “as available,” without a guarantee of uninterrupted or error-free operation.
Nothing in these terms excludes or limits liability for fraud, gross negligence, willful misconduct, or any liability or consumer right that cannot lawfully be excluded or limited. Physical-activity risks and any applicable liability provisions are addressed in the separate participant waiver and applicable law, not through a blanket release in these website terms.
12. Privacy, Governing Law, and Questions
Our Privacy Policy explains the information we handle, service providers, privacy choices, and photo opt-outs.
These website terms are governed by applicable Texas law and United States law, without taking away mandatory protections that apply to you under other applicable law. Nothing here requires arbitration, waives a class-action right, or prevents you from exercising a right to contact a regulator or court.
If a problem arises, we encourage you to contact us so we can try to resolve it. This invitation is not a condition on exercising a legal right. If a provision cannot lawfully be enforced, the remaining provisions continue to apply to the extent permitted by law.
13. Changes and Contact
We may update these website terms and will change the date shown above. We will give additional notice or obtain agreement when required by law. Changes do not retroactively change an accepted reservation or signed agreement without an appropriate legal basis.
